1. Acceptance of Terms
By accessing or using the website and platform “Llama Perks” (“Llama Perks”), you agree to be bound by these Terms and Conditions (“Terms”) and all applicable laws and regulations. If you do not agree to these Terms, you must not use Llama Perks.
In these Terms:
• The terms “Llama Perks,” “Llama Points,” and “bfm-solutions” all refer to Llama Perks unless otherwise specified.
• A registered user of Llama Perks is referred to as a “Perker.”
• A business owner or business entity introduced by a Perker is referred to as a “Customer.”
2. Changes to Terms
Llama Perks reserves the right to modify these Terms at any time. Any changes will be posted on this page. Continued use of Llama Perks after changes have been posted constitutes your acceptance of the revised Terms. No individual notification will be provided.
3. Use of Llama Perks
• You must be at least 18 years of age, or have parental or legal guardian consent, to use Llama Perks.
• You agree not to use Llama Perks for any unlawful purposes or in any way that may harm Llama Perks, its users, or its operations.
• Unauthorized use may result in the termination of your access to the platform.
4. Intellectual Property
• All content, trademarks, logos, software, and data on Llama Perks are the property of Llama Perks or its subsidiaries and are protected by applicable intellectual property laws.
• You may not reproduce, distribute, modify, or create derivative works of any content on Llama Perks without prior written permission from Llama Perks.
5. User Content
• You are solely responsible for any content or information you submit or upload to Llama Perks.
• By submitting content, you grant Llama Perks a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content.
• All information submitted to Llama Perks becomes the exclusive property of Llama Perks or its subsidiaries.
• Llama Perks reserves the right to remove any content at its sole discretion.
6. Privacy Policy

7. Disclaimer of Warranties
• Llama Perks is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
• Llama Perks does not warrant the accuracy, completeness, or reliability of any content or data on the platform.
• Llama Perks is not liable for any damages arising from your use of the platform.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Llama Perks, its subsidiaries, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your use of or inability to use the platform, even if Llama Perks has been advised of the possibility of such damages.
Users of Llama Perks are solely responsible for declaring and paying any applicable taxes in their jurisdiction.
9. Indemnification
You agree to indemnify, defend, and hold harmless Llama Perks, its subsidiaries, affiliates, directors, officers, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:
• Your use of Llama Perks;
• Your violation of these Terms;
• Any content you submit to Llama Perks.
10. Governing Law
These Terms are governed by the laws of the Canton of Schwyz, Switzerland, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Canton of Schwyz, Switzerland.

12. Specific Conditions for Perkers
12.1 Platform Ownership
Llama Perks is a platform owned and operated by BFM Solutions GmbH, a company registered in Lachen, Switzerland.
12.2 Legal Status of Perkers
• Perkers are individuals who register an account on Llama Perks to introduce business owners to the digital loyalty platform “Llama Points.”
• Perkers act as self-employed individuals and are not employees, agents, or contractors of Llama Perks, Llama Points, or BFM Solutions GmbH.
• No contractual relationship exists between the Perker and Llama Perks, Llama Points, or BFM Solutions GmbH beyond these Terms.
12.3 Purpose of Llama Perks
• Llama Perks serves as a reward-based platform for tracking introductions of businesses to the Llama Points application.
• Llama Points is a digital loyalty platform that helps businesses retain and reward customers through promotions and loyalty programs.
12.4 Customer Registration and Exclusivity Period.
Only businesses that are not already registered on the Llama Points application are eligible for registration on Llama Perks.
• Upon successful registration on Llama Perks, a Perker may submit basic business information about a potential Customer, including the business owner’s name, business address, email, and phone number.
• Once submitted, the Customer is associated exclusively with that Perker for a period of 30 calendar days.
• If the business signs up for the Llama Points application within this 30-day period, the Perker becomes eligible for rewards.
• If the business does not sign up within the 30-day period, Llama Perks reserves the right to release the business for registration by other Perkers.
12.5 Perker Responsibilities
• Perkers are responsible for working with business owners to install, set up, and facilitate the use of the Llama Points application.
13. Rewards and Payments
13.1 Eligibility for Rewards
Perkers may earn rewards in the form of money or vouchers under the following conditions:
Reward 1 – Initial Signup
Awarded if the following criteria are generally met (subject to Llama Perks’ discretion):
• The business signs up to Llama Points within 30 days of being registered by the Perker on Llama Perks.
• The business has conducted at least 11 scans using the Llama Points application.
• The business has acquired more than 5 loyal customers.
• The business has redeemed rewards at least once.
Each business category may be evaluated individually, and Perkers will be informed via their dashboard about payment status.
Reward 2 – Post-Trial Continuation
Awarded if the business remains subscribed to any Llama Points tariff after the 2-month free trial period.
Reward 3 – 6-Month Continuation
Awarded if, exactly six months after initial registration, the business remains subscribed to the middle or upper-tier Llama Points subscription.
13.2 Reward Amounts

13.3 Invoicing and Payment
• To claim a reward, the Perker must submit an invoice to BFM Solutions GmbH via email as per the instructions provided by Llama Perks when success criteria have been met.
• Payments will be processed within seven (7) calendar days of receiving a valid invoice.
• Payments will be made to the payment method specified in the Perker’s Llama Perks profile.
14. Communication
• Perkers may communicate with the Llama Perks team through their user dashboard.
• Llama Perks aims to respond to inquiries within 24 hours.

15. Taxes
• Each payment confirmation email from Llama Perks serves as proof of payment and may be used for tax filing purposes.
• Each Perker is solely responsible for declaring and paying any applicable taxes in their jurisdiction.
• Llama Perks and its subsidiaries decline any engagement or representation on behalf of a Perker regarding tax matters.
